Rental Agreement Terms and Conditions

1. Agreement & Acceptance

This Agreement is between Paradise Party Rentals LLC ("Company," "we," "us," or "our") and the customer ("Customer," "you," or "your"). By signing, making payment, or accepting delivery, Customer agrees to all terms.


2. Authority to Sign

The signer represents they are authorized to bind the Customer and personally guarantee all obligations.


3. Rental Items & Use

Items listed on the invoice ("Rented Items") are rented for the agreed period. Customer agrees to use all items safely, properly, and in accordance with instructions and applicable laws.

Customer assumes all risk associated with use, including injury, death, or property damage.


4. Payment Terms

You agree to pay all rental fees, taxes, delivery charges, and any other costs as detailed in the invoice. A 50% non-refundable deposit is required to reserve. Remaining balance is due 7 days prior to delivery. Late balances incur a 1.5% monthly finance charge. Returned payments are subject to a $35 fee. A valid credit card must be kept on file.

Additional items or services requested will be billed at standard rates.


5. Delivery, Setup & Access

Standard Delivery & Pickup

Standard delivery and pickup services are part of the Company’s normal operations and are included as a line item in the overall rental cost. Delivery fees are calculated based on factors such as distance from our location, quantity and type of Rented Items, site accessibility, and any special handling requirements.


Company will coordinate with Customer in advance to schedule mutually agreeable delivery and pickup time windows. While we make every effort to accommodate requested timeframes, specific delivery times are not guaranteed unless otherwise agreed to in writing.


Standard service includes delivery and pickup of Rented Items within 30 feet of the delivery vehicle. Service does not include stairs, rough terrain, narrow access points, or other obstacles unless specifically disclosed and approved in advance.


Access & Site Readiness

Customer must ensure safe and unobstructed access and a prepared site at the scheduled time. Delays caused by Customer will incur a $100/hour waiting fee (billed in 15-minute increments). If unresolved after 3 hours, Company may cancel services and retain deposit.


Setup & Takedown

Setup and takedown services are not included with standard rentals unless specifically quoted and paid for in advance. Exception: Professional setup and takedown are included for all tent and canopy rentals and will be performed by Company staff.


After-Hours Service

Available by prior arrangement for additional fees.


6. Inspection

Customer must inspect items upon delivery and note any discrepancies in writing. Failure to do so constitutes acceptance in good condition.


7. Tent & Canopy Requirements


Site Preparation

  • Area must be level, firm, and clear of debris or obstructions
  • Irrigation must be turned off prior to delivery
  • Clearance from structures, trees, and power lines must be ensured
  • Mow the lawn and remove vehicles, furniture, and animal waste from the setup area

Anchoring

Larger tents are typically secured using 3-4 foot stakes. If stakes cannot be used (concrete, asphalt, pavers, rocky ground, HOA restrictions, protected landscaping, or other reasons), additional weighted ballast (water barrels, cement blocks, sandbags, etc.) will be required at an extra charge.


Underground Utilities

When staking is permitted, customer shall be responsible for identifying all underground utilities, irrigation, and private lines. Company is not responsible for damage to unmarked lines. Customer should contact 811 where applicable.


Weather Responsibility

Customer is responsible for monitoring weather conditions and ensuring safe use of all Rented Items. Use during unsafe conditions—including high winds, heavy rain, or severe weather—is at Customer’s risk.


Company reserves the right, at its sole discretion, to delay installation, refuse setup, or require early takedown of tents or equipment if weather conditions are deemed unsafe or likely to cause damage or failure. In such cases, no refunds or reductions will be issued, as these actions are taken for safety and equipment protection.


8. Minor Site Impact

Customer acknowledges that delivery, setup, and removal of Rented Items may result in minor and unavoidable impact to the site. This may include, but is not limited to:

  • Small holes, indentations, or soil disturbance from stakes or equipment
  • Minor damage to grass, landscaping, or soft ground
  • Scuffs, scratches, or marks on hard surfaces such as concrete, decking, or patios

These conditions are considered normal and inherent to the setup and use of rental equipment. Customer agrees not to hold Company responsible for such minor or cosmetic impacts.

Company will make reasonable efforts to minimize site disturbance, but is not responsible for restoring the site to its original condition.


9. Return of Rented Items

Rented Items must be returned in substantially the same condition as received, allowing for normal wear and typical use. Items must be reasonably clean and free of excessive debris, food, or damage.


Dishes, glassware, flatware, and similar items must be emptied and rinsed free of food and residue. Linens should be shaken free of debris and returned without burns, wax, or permanent staining.


Rented Items should be stacked, organized, and ready for pickup in the same general manner as delivered. Failure to meet these conditions may result in additional cleaning, repair, or replacement charges.


Late returns may result in additional rental charges at the applicable rate.


10. Damage, Loss & Liability

Customer assumes full responsibility and risk for the Rented Items from the time of delivery (or pickup) until return to us, including any loss, theft, damage, or destruction beyond normal wear and tear. "Normal wear and tear" means only minor, unavoidable scuffs, light soiling from ordinary use, or small cosmetic marks that do not affect functionality, safety, or resale value.


Damage includes (but is not limited to):

  • Breakage, structural damage, or missing items
  • Tears, burns, stains, or excessive dirt
  • Damage from misuse, negligence, or improper use
  • Damage caused by weather, guests, or third parties

Customer must report issues promptly and agrees to pay full repair or replacement cost, including labor, shipping, administrative fees, and lost rental income. Company may inspect items within 72 hours of return.


11. Credit Card Authorization

Customer authorizes Company to charge the card on file for all amounts owed, including post-event charges such as damage, loss, cleaning, or extended rental periods.


12. Limitation of Liability

To the maximum extent permitted by law, Company’s liability is limited to amounts paid for the rental. Company is not liable for indirect, incidental, consequential, or punitive damages, including lost profits or business interruption. Carriers are not liable for delayed or undelivered text messages.


13. Indemnification

Customer agrees to defend, indemnify, and hold harmless Company from any claims, damages, or expenses arising from use of the Rented Items, site conditions, or Customer’s breach of this Agreement.


14. Insurance

Company may require proof of insurance naming Company as additional insured for certain events.


15. Cancellation & Changes

Cancellations must be in writing and are subject to the following:

  • 50% deposit is non-refundable
  • 30+ days: payments beyond deposit refunded
  • 8–29 days: 50% of total invoice due
  • 7 days or less: full invoice amount due

Order Changes: Customer may modify their order up to 14 days prior to the scheduled event date, including additions or reductions, subject to availability. Within 14 days of the event, additions or substitutions will be considered subject to availability; however, changes may not reduce the overall order total.


Rescheduling requests: Will be handled on a best-effort basis. Company will work with Customer to accommodate a new date, subject to inventory availability and existing scheduled events. Rescheduling is not guaranteed and, if unavailable, will be treated as a cancellation under the terms above.


16. Force Majeure

Company is not liable for delays or non-performance due to events beyond our reasonable control, including but not limited to severe weather, acts of God, strikes, pandemics, government actions, or site inaccessibility. In such cases, we will work with you in good faith to reschedule or provide appropriate credits or refunds at our discretion.


17. No Warranties

All Rented Items are provided "as-is" without warranties, express or implied, including merchantability or fitness for a particular purpose. We make no guarantees regarding performance or suitability.


18. Photographs and Marketing Use

Company may take photographs or videos of the Rented Items and event setup for quality control, documentation, and marketing purposes (including use on our website, social media, and promotional materials). If you do not wish for photos or videos of your event to be used for marketing purposes, please notify us in writing prior to the event date.


19. Governing Law

This Agreement is governed by the laws of California, with venue in Butte County. Prevailing party may recover attorney’s fees. This Agreement and invoice represent the full agreement. Invalid provisions do not affect the remainder.


20. Text Messages

By providing your mobile phone number as a contact method, you also agree and opt in to receive informational text messages from Paradise Party Rentals about your order (confirmations, delivery and pickup updates, and related customer care).

Acceptance

By signing, you acknowledge that you have read, understood, and agree to all terms and conditions in this Agreement.
